X1Q1 Labs, LLC (“X1Q1,” “Tixy,” “we,” “us,” or “our”) operates the Tixy website, games, applications, accounts, social features, and related services collectively referred to as the “Service.”
This Privacy Policy explains:

The Service is currently offered only to users located in the United States who are at least 13 years old.
By using the Service, you acknowledge the practices described in this Privacy Policy. This Privacy Policy should be read together with the Tixy Terms of Use and Community Guidelines.
1. Information We Collect
The information we collect depends on how you use Tixy, the features available to you, your age, and the choices you make.
1.1 Account and identity information
When you create or maintain an account, we may collect:

Where reasonably practical, we may retain the resulting age category instead of retaining a complete birth date.

Depending on the features you choose to use, your Tixy profile may include:

Other information that you choose to make available through your profile.
At launch, Tixy intends to offer preset avatars rather than custom image uploads.
If we later permit users to upload custom avatars or other images, we may collect:

Technical metadata associated with the file;

Moderation or safety determinations; and

Records concerning removal or reports.
We may resize, re-encode, scan, or remove metadata from uploaded images. We will update this Privacy Policy before or when material custom-upload functionality is introduced.
1.3 Game and activity information
When you use Tixy, we may collect information about your gameplay and use of the Service, including:

Some game information, such as scores, rankings, achievements, or match results, may be visible to other users.

If you use Tixy’s messaging or social features, we collect:

Delivery and read status, if supported;

Related account, safety, and moderation records; and

Limited surrounding context when reasonably necessary to investigate a report.
At launch, we do not intend to routinely have employees read or pre-screen every direct message.
We may access, preserve, or review messages when:

A participant reports a message or account;

A message is otherwise brought to our attention;

We reasonably suspect harassment, exploitation, fraud, abuse, cheating, or a security threat;

Review is necessary to enforce our Terms or Community Guidelines;

A user requests support;

We need to troubleshoot message delivery; or

Disclosure or preservation is required by law.
We reserve the right to introduce automated tools that identify spam, threats, vulgarity, harassment, exploitation, malicious links, or other prohibited activity. If automated message screening materially changes our privacy practices, we will update this Privacy Policy and provide any additional notice or choice required by law.
We do not use private-message content to select advertising or sponsored offers.
Recipients may copy, screenshot, record, or redistribute messages. We cannot control information retained or shared independently by another user.
1.5 Reports, safety, and moderation information
When you report another user, appeal an action, or contact us about safety, we may collect:

Users known to be ages 13 through 15 will not be enrolled in paid third-party promotions, sponsored product offers, or affiliate marketing.
Users ages 16 and 17 may receive sponsored or affiliate marketing only after a separate affirmative opt-in and only when the promotion is appropriate for their age.
1.8 Technical and device information
When you access the Service, we and service providers acting on our behalf may automatically collect:

We may use cookies, local storage, session identifiers, pixels, software-development kits, or similar technologies for purposes such as:

1.10 Fraud-prevention and CAPTCHA information
We may use a CAPTCHA, challenge, honeypot, rate-limiting service, or other fraud-prevention technology on registration, login, account-recovery, messaging, or contact forms.
These systems may process:

A sponsored offer may be paid for by another company. Unless we provide different notice and obtain any required permission, X1Q1 will send the communication and will not provide the sponsor with the recipient’s email address or account profile.
4. Information Visible to Other Users
The social nature of Tixy means some information is intended to be shared with other users.
Depending on your settings and available features, other users may see:

Your email address, private full name, birth information, password, and account-security information are not public.
We may limit the visibility or discoverability of minor-user profiles. Profiles may be available only to logged-in users and may be excluded from public search-engine indexing.
You should not include the following in a public profile or message:

Home or school address;

Precise location;
-
Telephone number;
-
Email address;
-
Password;
-
Financial information;
-
Government identifier;
-
School schedule;
-
Private social-media handle; or
-
Other information that could create a safety risk.
5. When We Disclose Personal Information
We do not sell personal information, and we do not share personal information for cross-context behavioral advertising as of the Effective Date of this Privacy Policy.
We may disclose personal information in the following circumstances.
5.1 To other users
We disclose public-profile information, game information, and social content according to the feature being used and applicable privacy settings.
Direct messages are disclosed to their intended recipients.
5.2 To service providers and contractors
We may disclose information to companies that perform services on our behalf, such as:

Service-provider processing is different from allowing another company to use Tixy information for that company’s independent advertising.
5.3 For legal, safety, and enforcement purposes
We may disclose information when we reasonably believe disclosure is necessary to:

5.6 In aggregated or de-identified form
We may use and disclose information that has been aggregated or de-identified so that it cannot reasonably be linked to a particular person.
We will not attempt to reidentify information that we maintain as de-identified except as permitted by law to test whether the de-identification process is effective.
6. Advertising and Sponsored Promotions
Tixy does not currently use personal information for cross-context behavioral advertising.
We may introduce advertising in the future. Advertising may include:

Contextual advertisements based on the page or game being used;

Sponsored content;
-
Affiliate links;
-
Offers sent by X1Q1 to users who separately opted in; or

Other age-appropriate promotions.
Before introducing advertising practices that materially change how personal information is collected, used, or disclosed, we will:

Regardless of whether a sale or sharing would otherwise be lawful, users known to be ages 13 through 15 will not receive paid third-party marketing offers under Tixy’s current policy.

Optional marketing will be presented separately from acceptance of the Terms of Use.
You may unsubscribe from marketing by:

We may retain a limited suppression record to ensure that we continue to honor an unsubscribe request.
Unsubscribing from marketing does not stop:

Purchase confirmations;

Material legal notices; or
-
Other communications necessary to provide the Service.
8. Browser Privacy Signals and Cross-Site Tracking
8.1 Do Not Track
Some browsers transmit a “Do Not Track” signal. There is no single universally accepted standard governing how websites must respond to that signal.
Because Tixy does not currently engage in cross-context behavioral advertising, a Do Not Track signal does not presently change our practices.
8.2 Global Privacy Control and similar signals
Where applicable law requires us to recognize an opt-out preference signal, such as Global Privacy Control, we will treat a valid signal as a request to opt out of the sale or sharing of personal information for the browser or device transmitting it.
Because we do not currently sell or share personal information for cross-context behavioral advertising, such a signal does not presently result in an additional change to our practices.
8.3 Third-party collection across services
At launch, we do not intend to permit advertising networks to collect information through Tixy in order to track users across unrelated websites or services.
Service providers used for security, fraud prevention, hosting, analytics, or similar operational purposes may receive technical information when you use Tixy. Their collection is limited to providing services to X1Q1 or other purposes described in their applicable agreements and notices.
We will revise this section if we later introduce advertising or tracking technologies that materially alter these practices.
9. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

11. Your Choices and Controls
11.1 Account and profile settings
You may be able to review or change certain information through your account settings, including:

You may delete certain profile information or content using available account tools.
Deleting content does not necessarily remove:

Screenshots;

Content quoted or reposted by another user;

Safety or legal records;
-
Backups awaiting ordinary deletion; or
-
Information we are legally permitted or required to retain.
11.3 Closing an account
You may request account closure through available account controls or by contacting support@x1q1.com.
We may need to verify that the person making the request controls the account.
11.4 Blocking and reporting
Where supported, you may:

Block another user;
-
Mute communications;
-
Remove a connection; or
-
Report content or conduct.
Blocking a user may prevent future contact but may not automatically delete prior messages or game records.
11.5 Marketing
You may opt out of optional marketing as described in Section 7.
12. Children and Teen Users
12.1 Users under 13
Tixy is not intended for children under 13, and we do not knowingly permit them to create accounts.
We use an age screen designed to determine whether a user is eligible for the Service. A user must provide truthful age information and may not evade the age screen.
If we learn that a user is under 13, we may:

Prevent further collection;
-
Delete the account and associated personal information;
-
Preserve limited information needed for safety or legal purposes; and

Take other steps required by applicable law.

We may provide minors with additional protections, including:

We do not publicly display a minor user’s complete birth date or exact age.
12.3 Removal rights for California minors
A registered user under 18 who resides in California may request removal of content or information the user posted through the Service.
A request may be submitted through available deletion controls or by emailing support@x1q1.com.
The request should identify:

The content to be removed; and
-
Where the content appears.
Removal does not ensure complete deletion. Information may remain where:

Another user independently copied or reposted it;

Law requires or permits retention;

It has been anonymized;

Removal is otherwise subject to a statutory exception.
13. California Privacy Rights
This section applies to California residents to the extent the California Consumer Privacy Act, as amended (“CCPA”), applies to X1Q1 or the relevant processing.

You may have the right to request:

13.4 Right to data portability
You may have the right to receive certain personal information in a portable and, where technically feasible, machine-readable format.
13.5 Right to opt out of sale or sharing
You may have the right to opt out of:

The sharing of personal information for cross-context behavioral advertising.
As of the Effective Date, X1Q1 does not sell personal information or share it for cross-context behavioral advertising.
We have not sold or shared personal information for those purposes during the preceding 12 months.
13.6 Right to limit sensitive personal information
If we use or disclose sensitive personal information for purposes beyond those permitted without a limitation right, you may have the right to direct us to limit that use or disclosure.
We presently use sensitive information, such as login credentials, age information, and private-message content, only for purposes reasonably necessary to provide, secure, support, and enforce the Service or as otherwise permitted by law.
13.7 Right to nondiscrimination
We will not unlawfully discriminate against you because you exercised an applicable privacy right.
